VIC: Residential Tenancies Act Section 207ZE Closure of Part 4A park

Closure of Part 4A park

(1) Subject to subsection (2), a site owner may give a resident a notice to vacate a site if the Part 4A park is to be closed.

(2) At least 14 days before giving a notice to vacate under subsection (1), the site owner must give written notification to the municipal council in which the Part 4A park is situated of the proposed closure of that park. Penalty: in the case of a natural person— 60 penalty units; in the case of a body corporate— 300 penalty units.

(3) The notice must specify a termination date that is not less than 365 days after the date on which the notice is given. Note See also section 215A in relation to compensation for eligible site tenants and effect on validity of notice to vacate.

(4) If a site agreement specifies a day on which the site agreement is to end, the notice cannot specify a termination date that is earlier than the day on which the site agreement is to end.

(5) Failure to give the written notification under subsection (2) does not invalidate any notice to vacate given under subsection (1).
