VIC: Residential Tenancies Act Section 332 Order not to be made in certain circumstances

Order not to be made in certain circumstances (1) Despite section 330, the Tribunal must not make a possession order if—

(a) the application for the order is supported with a notice to vacate given under section 91ZO, 142ZG, 206AW or 207ZA; and

(b) the Tribunal is satisfied that— (i) the failure to comply with an order of the Tribunal was trivial or has been remedied as far as possible; and (iii) the breach of duty is not a recurrence of a previous breach of duty.
