When does Part not apply to occupation of SDA enrolled dwelling

(1) Subject to Division 2, nothing in this Part affects the right of any of the following persons to enter into a residential rental agreement in respect of an SDA enrolled dwelling with an SDA provider by mutual agreement— (a) an SDA resident; (b) any person who is not an SDA resident.

(2) If an SDA provider and SDA resident have entered into a residential rental agreement in respect of an SDA enrolled dwelling, this Part (other than Division 2 to the extent specified in that Division) does not apply to the SDA provider and the SDA resident while the residential rental agreement continues.
