Order not to be made in certain circumstances Despite section 498ZZH, the Tribunal must not make a possession order if— (a) the application for the order is supported with a notice to vacate issued on a ground specified in section 498ZX(1)(l); and
(b) the Tribunal is satisfied that— (i) the failure to comply with an order of the Tribunal was trivial or has been remedied as far as possible; and ***** (iii) the breach of duty is not a recurrence of a previous breach of duty.
