VCAT has recently announced some procedural changes that aim to clear the back log of residential tenancies matters by the end of 2024. With this clearance program comes to use of 'on the papers' hearings, these are hearings where the member will make a decision based on the evidence provided to VCAT without the need for the parties to attend a hearing. With this new procedure it is vitally important that you present your evidence in the best possible manner to achieve a favourable result. Your written evidence will be all that matters for these hearings.
During this session we will look at the new procedures and importantly discuss how best to present your summary of proofs and evidence to maximise the chances of a favourable hearing.
We will make available to all participants a sample presentation of the summary of proofs and evidence that will not only guide you in the right direction for 'on the papers' hearings, but also be beneficial for presentation at any VCAT hearing.
