Notice to Vacate - End of fixed term
I am finding these End of Fixed term tenancy notices are continuing to cause drama and confusion. Hearing of a matter that only today was dismissed as the NTV went on to explain reasons further than "the owner is exercising their right..." with the member saying the extra statement was confusing and the law only required the statement that "the owner is exercising....". The attached case is not todays, it is from last year but is interesting reading predominantly points 22 to 27. These decisions are in spite of other hearings and suggestions from VCAT senior members that some further reasoning is required. The main thing we get from this is the importance of knowing relevant precedent to present at your hearing that will help your argument.
