VIC: Application after issuing an NTV
Good morning all, I have been following a post on another page and thought it was worthwhile commenting on the topic here, this is VIC based regarding applications to VCAT after issuing a Notice to Vacate.
An application for possession being made under section 322(1) can be made at anytime after the NTV is issued but not later than 30 days after the NTV's termination date. If it was the renter that provided a Notice of intention to vacate then you must wait until after the termination date, but for NTV's issued by the RRP there is no requirement to wait until after the termination date. Refer to RTA Section 326(1)

After the NTV is deemed served so after the postage allowance time etc. also remember this does not apply to NTV and Applications relating to arrears - refer to section 91ZM for arrears.
